Purpose :
These General Terms and Conditions of Sale, abbreviated under the acronym “GTC”, establish the provisions and terms governing commercial transactions between the company “Kizuna.Mg”,hereinafter referred to as “The Seller”, and any natural person who proceeds to purchase a product via the website https://takelakaroa.mg, from now on referred to as “The Client”.

The products available for sale are those displayed on the Seller’s website, subject to availability. Product images are provided for illustrative purposes only and are not contractually binding.
Order process
Orders are placed through the Seller’s website and are confirmed only upon full payment of the total amount. The Seller reserves the right to cancel any order from a Client involved in a dispute, without refund.
By confirming an order, the Client fully and unconditionally accepts these General Terms and Conditions of Sale.
Prices
All prices are indicated in Malagasy Ariary (MGA).
Delivery costs are not included in the product prices and will be added at checkout.
The Seller reserves the right to change prices at any time; however, products will be invoiced based on the rates applicable at the time of order confirmation.
Payment terms
Payment is made by bank card via a secure online payment system or by any other payment method available on the website. Payment is due immediately upon ordering. The Seller reserves the right to suspend or cancel any order in the event of payment authorization refusal by accredited institutions or in the case of non-payment.
Shipping and Delivery
Order preparation takes up to 72 hours from receipt, from Monday to Friday, excluding public holidays.

The Seller cannot be held liable for any delivery delays.
Products are delivered to the address provided by the Client at the time of order. In case of incorrect address or failure to collect the order within the specified timeframe at a pickup point, reshipping costs will be charged to the Client.
Complaints
Upon receiving the order, the Client is responsible for immediately checking its contents.
Any defect or discrepancy (damaged, missing, or non-compliant product) must be reported in writing within 48 hours to: contact@takelakaroa.mg or by postal mail (postmark serving as proof).

Returns and Refunds
The Client has a period of 15 calendar days from the date of receipt of the product to exercise their right of withdrawal.
The withdrawal period starts from the date the product is received.
The Client must notify the seller of their decision to withdraw before the expiration of the 15-day period by email at: contact@takelakaroa.mg
The product must be returned within 15 days of the withdrawal notification, in its original condition and accompanied by the invoice, to the following address:

All return costs are borne exclusively by the Customer.
No item may be returned if it has been used even partially, is incomplete, damaged, stained, or soiled by the Client, or if the original packaging of sealed products has been opened (for hygiene or data protection reasons).
Refunds will be processed within 15 days from receipt of the returned product by the Seller or from proof of shipment provided by the Client.
Refunds will be issued using the same payment method as the original transaction unless otherwise agreed by the client.
Please note : initial delivery costs are non-refundable (only the product price will be refunded).
Returning a product without prior withdrawal notification, or refusing delivery, does not constitute a valid expression of the Client’s intent to withdraw.
All content on the website, images, logos, text, and videos on the website are protected by intellectual property laws..

Any reproduction, distribution, modification, or unauthorized use is strictly prohibited without prior written consent.
All trademarks, logos, and product names are also protected and may not be used without the express authorization of their legal owner.
Any act of violation may result in legal action in accordance with applicable laws.
Accessing the site does not grant any rights over the intellectual property of KIZUNA.MG or any third party.

Should a dispute arise from the interpretation, performance, or termination of these General Terms and Conditions of Sale, the parties shall make every effort to resolve it amicably.
If no amicable agreement is reached, the dispute shall be resolved in accordance with the applicable legal provisions in force.
These General Terms and Conditions of Sale and all transactions arising therefrom are governed by Malagasy law.
Any dispute that cannot be resolved amicably shall be brought before the Malagasy civil courts.
Products remain the exclusive property of the Seller until full payment of their price has been received. In the event of total or partial non-payment, the Seller may demand the immediate return of the delivered products at the Customer's expense and risk.
In the event of force majeure, the Seller shall not be held liable for failure to fulfill its contractual obligations.
The following shall be considered force majeure events: natural disasters, fires, strikes, epidemics, wars, government restrictions, computer or network failures beyond the Seller's control.
The Seller undertakes to provide its products and services with due diligence and professionalism, in accordance with the agreed standards and specifications.
With regard to products sold, the Seller guarantees their conformity with the description provided on the website, with the exception of images which are not contractually binding, in accordance with applicable law. Any claim regarding the non-conformity of a product must be submitted in accordance with Article 7 of these General Terms and Conditions of Sale.
The Seller's liability is limited to the amount paid by the Customer for the products or services in question, except in cases of willful misconduct or gross negligence.
The Seller reserves the right to modify, update or suspend its website, products and services at any time without notice, and shall not be held liable for the consequences of such changes. In such cases, all confirmed orders will be fulfilled by the Seller.
If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such under any law, regulation or following a final decision by a competent court, the remaining provisions shall retain their full force and effect.
