The Seller reserves the right to cancel any order from a Client involved in a dispute, without\nrefund.<\/p><p>By confirming an order, the Client fully and unconditionally accepts these General Terms and\nConditions of Sale.<\/p><p><strong>Prices<\/strong><\/p><p>All prices are indicated in Malagasy Ariary (MGA).<\/p><p>Delivery costs are not included in the product prices and will be added at checkout.<\/p><p>The Seller reserves the right to change prices at any time; however, products will be invoiced based on\nthe rates applicable at the time of order confirmation.<\/p><p><strong>Payment terms<\/strong><\/p><p>Payment is made by bank card via a secure online payment system or by any other payment method\navailable on the website. Payment is due immediately upon ordering. The Seller reserves the right to\nsuspend or cancel any order in the event of payment authorization refusal by accredited institutions or\nin the case of non-payment.<\/p><p><strong>Shipping and Delivery<\/strong><\/p><p>Order preparation takes up to 72 hours from receipt, from Monday to Friday, excluding public holidays.<\/p><p>Delivery times vary depending on the destination and shipping method:<\/p><ul><li>France: approximately 7 business days<\/li><li>European Union countries: 10 to 12 business days<\/li><li>Indian Ocean region: approximately 72 hours<\/li><li>International: estimated 11 to 31 days (indicative timeframe, excluding customs processing)<\/li><\/ul><p>\u00a0<\/p><p>These delivery times are indicative and not guaranteed.<\/p><p>The Seller cannot be held liable for any delivery delays.<\/p><p>Products are delivered to the address provided by the Client at the time of order. In case of incorrect\naddress or failure to collect the order within the specified timeframe at a pickup point, reshipping costs will be charged to the Client.<\/p><p><strong>Complaints<\/strong><\/p><p>Upon receiving the order, the Client is responsible for immediately checking its contents.<\/p><p class=\" translation-block\">Any defect or discrepancy (damaged, missing, or non-compliant product) must be reported in writing\nwithin 48 hours to:<strong> contact@takelakaroa.mg <\/strong>or by postal mail (postmark serving as proof).<\/p><p><strong>Warranty<\/strong><\/p><p>The products are guaranteed to comply with the descriptions provided on the company\u2019s website.<\/p><p>The Seller guarantees compliance with applicable legal provisions, including:<\/p><ul><li>Legal warranty against hidden defects (Articles 1641 to 1649 of the Civil Code)<\/li><li>Legal warranty of conformity (Articles L217-4 to L217-14 of the Consumer Code)<\/li><\/ul><p>\u00a0<\/p><p><strong>Returns and Refunds<\/strong><\/p><ul><li><strong><em>Right of Withdrawal<\/em><\/strong><\/li><\/ul><p>The Client has a period of 15 calendar days from the date of receipt of the product to exercise their\nright of withdrawal.<\/p><p>The withdrawal period starts from the date the product is received.<\/p><ul><li><strong><em>How to exercise the right of withdrawal<\/em><\/strong><\/li><\/ul><p class=\" translation-block\">The Client must notify the seller of their decision to withdraw before the expiration of the 15-day\nperiod by email at: <strong>contact@takelakaroa.mg<\/strong><\/p><ul><li><strong><em>Return of Products<\/em><\/strong><\/li><\/ul><p>The product must be returned within 15 days of the withdrawal notification, in its original condition\nand accompanied by the invoice, to the following address:<\/p><p><strong>KIZUNA.MG,<\/strong><\/p><p><strong>LOT II I 160 B Alarobia<\/strong><strong>, <\/strong><strong>Antananarivo<\/strong><\/p><p><strong>MADAGASCAR<\/strong><\/p><p>All return costs are borne exclusively by the Customer.<\/p><ul><li><strong><em>Return conditions<\/em><\/strong><\/li><\/ul><p>No item may be returned if it has been used even partially, is incomplete, damaged, stained, or soiled\nby the Client, or if the original packaging of sealed products has been opened (for hygiene or data\nprotection reasons).<\/p><ul><li><strong><em>Refunds<\/em><\/strong><\/li><\/ul><p>Refunds will be processed within 15 days from receipt of the returned product by the Seller or from\nproof of shipment provided by the Client.<\/p><p>Refunds will be issued using the same payment method as the original transaction unless otherwise\nagreed by the client.<\/p><p class=\" translation-block\"><strong>Please note<\/strong>  : initial delivery costs are non-refundable (only the product price will be refunded).<\/p><ul><li><strong><em>Important notice<\/em><\/strong><\/li><\/ul><p>Returning a product without prior withdrawal notification, or refusing delivery, does not constitute a\nvalid expression of the Client\u2019s intent to withdraw.<\/p><ul><li><strong>INTELLECTUAL PROPERTY<\/strong><\/li><\/ul><p>All content on the website, images, logos, text, and videos on the website are protected by intellectual\nproperty laws.<span style=\"text-decoration: line-through;\">.<\/span><\/p><p>They remain the exclusive property of partner publishing houses.<\/p><p>Any reproduction, distribution, modification, or unauthorized use is strictly prohibited without prior\nwritten consent.<\/p><p>All trademarks, logos, and product names are also protected and may not be used without the express\nauthorization of their legal owner.<\/p><p>Any act of violation may result in legal action in accordance with applicable laws.<\/p><p>Accessing the site does not grant any rights over the intellectual property of KIZUNA.MG or any third\nparty.<\/p><p>Clients are allowed to use the website only for its intended purpose. Any other use, reproduction, or\ndistribution is strictly prohibited without prior written authorization.<\/p><ul><li><strong>DISPUTE RESOLUTION, APPLICABLE LAW AND JURISDICTION<\/strong><\/li><li><strong><em>Dispute resolution<\/em><\/strong><\/li><\/ul><p>\u00a0<\/p><p>Should a dispute arise from the interpretation, performance, or termination of these General Terms\nand Conditions of Sale, the parties shall make every effort to resolve it amicably.<\/p><p>If no amicable agreement is reached, the dispute shall be resolved in accordance with the applicable\nlegal provisions in force.<\/p><ul><li><strong><em>Applicable law<\/em><\/strong><\/li><\/ul><p>These General Terms and Conditions of Sale and all transactions arising therefrom are governed by\nMalagasy law.<\/p><ul><li><strong><em>Competent court<\/em><\/strong><\/li><\/ul><p>Any dispute that cannot be resolved amicably shall be brought before the Malagasy civil courts.<\/p><ul><li><strong>RETENTION OF TITLE CLAUSE<\/strong><\/li><\/ul><p>Products remain the exclusive property of the Seller until full payment of their price has been received.\nIn the event of total or partial non-payment, the Seller may demand the immediate return of the delivered products at the Customer's expense and risk.<\/p><ul><li><strong>FORCE MAJEURE<\/strong><\/li><\/ul><p>In the event of force majeure, the Seller shall not be held liable for failure to fulfill its contractual\nobligations.<\/p><p class=\" translation-block\">The following shall be considered force majeure events: natural disasters, fires, strikes, epidemics,\nwars, government restrictions, computer or network failures beyond the Seller's control.<\/p><ul><li><strong>SELLER'S LIABILITY<\/strong><\/li><\/ul><p>The Seller undertakes to provide its products and services with due diligence and professionalism, in\naccordance with the agreed standards and specifications.<\/p><p>With regard to products sold, the Seller guarantees their conformity with the description provided on\nthe website, with the exception of images which are not contractually binding, in accordance with\napplicable law.
